Press Release Man Charged IN MUdding Incident

Man Charged In Mudding Incident

A Fargo man has been charged with driving on a flood protective works and may be held liable for damages caused by his vehicle during a recent mudding incident. Joel Scheving, 18, Fargo was cited at about 1:30 PM on 9 June 2013 after he and his vehicle were located in an area along the West Fargo-Horace Diversion north of 21st Ave West. Scheving drove his vehicle across open fields and onto the west bank of the diversion. Scheving reportedly lost control of the vehicle and became stuck. Driving on a flood protective works is a class B Misdemeanor and punishable by a fine up to $1000 and/ or 30 days in jail. In addition, the driver may be held liable for damages caused as the result of their actions.

Chris Brungardt, Assistant Director of West Fargo Public Works, estimates the dollar damage caused by Scheving’s vehicle to be $2200. Brungardt expressed concern that someone would choose to drive on the diversion. Brungardt said, “The water is currently high in the diversion due to releases from Bald Hill Dam north of Valley City. When an individual decides to drive in those areas closed to vehicle traffic they expose themselves to the danger presented by the high water. Violators also cause damage that can affect the flood protection offered by the diversion system. Driving in closed areas causes ruts or creates areas of erosion which can weaken the embankment.” Brungardt hopes others will take this as a warning to remain clear of areas closed to vehicle traffic.

Mudding is the act of driving a vehicle upon roadways and open fields following a rain event. Drivers attempt to challenge the capabilities of the vehicle to overcome the adverse driving conditions. This activity can cause damage to the roadway or open field areas where the driving is occurring. Drivers causing damage can be fined and may have to pay civil penalties.
